I agree to use the PowerPlan File Transfer Server only in the performance of my professional duties and not for personal use. I will refrain from disclosing any PowerPlan, Roper, customer, or business partner confidential or proprietary information to any recipients that are not authorized to access such information. For example:
• I will not use the PowerPlan File Transfer Server to share PowerPlan confidential or proprietary information with individuals or entities that are not authorized to possess such information, do not have a need to know such information, and do not have a contractual or other obligation to keep such information confidential.
• I will not use the PowerPlan File Transfer Server to share customer or business partner confidential or proprietary information with individuals or entities (including PowerPlan) that are not authorized to possess such information, do not have a need to know such information, and do not have a contractual or other obligation to keep such information confidential.
If I have questions about whether the information I intend to share via the PowerPlan File Transfer Server is confidential and/or proprietary, or if the intended recipient is authorized to access such information, has a need to know such information, and has an obligation to keep such information confidential, I will contact PowerPlan’s Legal Department if I am a PowerPlan employee or contractor or my company’s Legal Department if I am not a PowerPlan employee or contractor.
If I am not a PowerPlan employee or contractor, to the extent I submit personal data, I consent to the use of that data and represent to PowerPlan that I have received express consent from the individual persons whose data is being used/transferred prior to sending this data through the PowerPlan File Transfer Server. I certify that I have obtained the personal data pursuant to applicable data protection laws and have obtained all necessary authorizations and consents with respect to such data. I acknowledge and agree that PowerPlan is a processor of such personal data processed by the PowerPlan File Transfer Server and shall have no obligations as a controller of data according to the laws of any member country of the European Economic Area or other country.
